Federal Court Warns Insurer of Sandy Claim Practices

By Thomas J. Bracken, Esq. , Stalker, Vogrin, Bracken & Frimet, LLP

In a recent Order in a New York federal court case regarding Sandy claims, a federal magistrate had very strong instructions and warnings for an insurer and its engineering expert regarding claims practices resulting from the Storm.  In the case, Deborah Raimey and Larry Raisfeld v. Wright National Flood Insurance, Co, (14 CV 461, EDNY, memorandum dated November 7, 2014), Magistrate Judge Gary Brown sanctioned the insurer and ordered production in discovery of all draft, redlined, or marked up reports to the Plaintiffs in response to what Judge Brown cited was “reprehensible gamesmanship by a professional engineering company that unjustly frustrated efforts by two homeowners to get fair consideration of their claims.”  However, the biggest takeaway from this Opinion is that Judge Brown suggests “these unprincipled practices may be widespread.”
